AAT MERITS REVIEW APPEALS
If you have recently had a visa refused or cancelled or a citizenship application refused, then there are steps that can be taken to have the decision reviewed by the Migration and Refugee Division of the Administrative Appeals Tribunal.
The Migration and Refugee Division of the Administrative Appeals Tribunal is an independent body that conducts merits review of visa and visa-related decisions made by the Department of Immigration and Border Protection.
Merits review is a process by which there is a reconsideration of a decision made by a government department. The objective of this review process is to ensure that correct decisions are made.
The Administrative Appeals Tribunal Member who reviews the case is able to consider new evidence and new submissions that were not before the original decision-maker at the time of their decision. After reviewing this new evidence the Member may substitute the original decision made about a visa application or cancellation for a more favourable one.
Time is a key factor in applying for a review of a decision. After you have had a visa refused or cancelled you only have a short time period in which you can apply for review.
